Definitions

We, Us, Our shall mean Seasmart Marine Ltd, trading as Seasmart Marine.

General

These terms and conditions are given to outline our policies and to comply with the EC Distance Selling Directive. You should note that your statutory rights under the current consumer protection laws are not affected.

Contract

After placing an order, you will receive an email from us acknowledging receipt of your order. This constitutes an offer by you, to us to purchase a product. The contract to supply will relate only to those products which we have despatched.

Supply

We undertake to supply you with the goods described in these web pages. Unless we have specifically agreed otherwise, delivery will be as soon as possible (normally 3 to 5 working days) and not longer than 30 days. Occasionally items are not immediately available, we will send as much of your order as we immediately can and despatch the unavailable item, by the quickest means possible at no extra charge to you.

Product Description and Images

We aim to be as accurate as possible. However we cannot guarantee that any descriptions or images are error-free. Should you find something that is inaccurate, please contact us and we will remedy it as soon as possible.

Delivery 

Delivery charges will be detailed and shown upon ordering and before the “checkout” process. Our standard delivery charges are dependent on the weight of the items ordered and the delivery region. 

For international destinations not listed please contact us for a delivery estimate via our ”contacts” page, email or by telephone.

If you have special delivery requirements, eg next day/ Saturday delivery, please contact us for an estimate.

Returns and Refunds

We want you to be satisfied with the products you buy from us. If you receive a product that is faulty or damaged we will be happy to replace it.  

European Distance Selling Directive   

Customers who buy from us by means defined in the DSD as “distance selling” and who are private individuals as defined by the DSD are entitled within 7 days working days of receipt of goods and without reason to cancel their order and to be refunded the price that they have paid. Customers must return the goods at their expense, and the goods must arrive at our premises unused, in as-new condition and in their original packaging.

This right to cancel does not apply to products manufactured to special order and identified as such by us to the customer at the time of ordering.

Payment

We are happy to accept payment by credit or debit card. Once payment has been received your order will be processed and despatched. Our payment system is secure. 

If you have any queries or problems with the payment system please contact us and we will do our best to resolve the situation.

Pricing

All prices are subject to alteration with no prior notice.

Special deals are strictly subject to availability.

VAT 

All the prices quoted on the website are inclusive of UK VAT at the current rate.

Export orders outside the EU will not be charged VAT. 

EU businesses outside the UK must give their EU VAT number when placing an order, to avoid paying UK VAT.

Complaints

We do not have a rigid complaints procedure, but we take any complaint very seriously and would expect to contact you as soon as possible after a problem has been brought to our attention.

Law and Jurisdiction

Any contract a customer may have with us shall in all respects be construed according to and be governed by English Law and the customer agrees to submit to the exclusive jurisdiction of the English Courts in any dispute or difference of any kind which may arise concerning the contract.

Guarantee/ Warranty

We guarantee that all new equipment sold by us is free from defects in material or workmanship. Our liability under this guarantee is limited to making good any part or parts which shall, within one year from the date when the equipment was delivered new to the customer, be returned to us and which we are satisfied on our examination to have been defective in material or workmanship. Included in this guarantee are the costs of labour incurred by us in making good such part or parts.

This guarantee is given on condition that:

a) we are notified in writing within fourteen days after such defects appear and the equipment or defective parts are returned to us as soon as reasonably practical.

b) the equipment has in our judgement been correctly installed and normally used in accordance with the instructions provided for its installation operation and maintenance.

c) unless performance figures and performance tolerances have been stipulated by the purchaser and agreed by us at the time of ordering the equipment we shall be under no liability in the absence of any defect in material or workmanship for failure to obtain any particular performance.

d) if the equipment has in our judgement been altered, taken apart, repaired, tampered with, neglected, damaged or used in any way so as adversely to affect its performance or condition we shall not be liable for any fault arising from its use.

e) we shall not be liable for faults arising from the use of any spare or replacement parts not authorised or recommended by us.

f) we shall not be liable for faults or damage arising from the use of any sanitising refill product not supplied by us.

g) any equipment or defective part replaced by us shall become our property.

h) the decision whether to repair or replace a defective part under warranty claim / guarantee shall be at our discretion.

i) excluded from this warranty are any parts which need replacement due to normal wear and tear.

j) carriage to our works of any equipment or parts returned to us under a warranty claim shall be the responsibility of and at the expense of the claimant.

k) we accept no responsibility for loss or damage howsoever occasioned to customers’ goods whilst such goods are in transit to or from ourselves or in the possession of or in transit to or from our agents.

l) we give no warranty in respect of equipment supplied by us except the foregoing warranty and without prejudice to the generality of the foregoing we shall be under no liability whether in contract or otherwise in respect of any defects in the goods or from any injury loss or damage resulting from such defects or from any work done in connection therewith and we shall not in any circumstances be liable for any consequential loss or damage suffered including any loss of use, loss of contract or loss of profits. Our liability shall in no case exceed the value of the goods supplied by us in relation to which the claim is made.

m) the purchaser acknowledges that the equipment is sold to him in consideration of payment of the price and of the undertaking on the part of the purchaser to:-

-observe all prudent trade practices in relation to installation and user so that the equipment is not used when it is in an unsafe condition for whatever purpose.

-ensure in so far as the equipment is incorporated into other equipment that such other equipment is in good working order and that such incorporation is in accordance with what that manufacturer would require.

- ensure that users of the equipment are adequately informed of their duties in relation to the equipment supplied.

-observe the Health and Safety at Work legislation as amended from time to time in relation to the equipment supplied

So that we shall not be liable in any respect of the purchaser’s failure to observe the conditions set out above.

The foregoing warrant is given without prejudice to purchasers’ statutory rights.

Liability

We cannot be held liable for any loss or damages caused directly or indirectly from this Website.

Our products are supplied on condition that seacocks connected in any way to our products are always closed when any craft is left unattended.

We cannot be held liable for any loss or damages caused by any products supplied by SeaSmart Marine Ltd. or their installation.

We shall be under no liability whether in contract or otherwise in respect of goods or from any injury loss or damage resulting from our products or any work done in connection therewith and we shall not in any circumstances be liable for any consequential loss or damage suffered including any loss of use, loss of contract or loss of profits. Our liability shall in no case exceed the value of the goods supplied by us in relation to which the claim is made.
